If you rent a house, apartment, condominium or mobile home to or from another person, you are most likely entering into a legal contract known as a rental agreement. This rental agreement need not be in writing to still be enforceable in Florida. 

If the rental agreement is in writing, then the language of the agreement and the Florida Statutes will guide your rights as a landlord or renter.  Even in the absence of a written lease, the law in Florida imposes duties on landlords and renters, and gives rights to these same parties.  An obvious right for a landlord, for example, is to receive rent for the use of the property and to have their property returned undamaged at the end of the agreement. In return, a landlord has the obligation to, and the renter the right to, a rental home that is safe and meets housing code requirements, as well as reasonable repairs during the rental period when necessary. These types of obligations can be limited sometimes under the lease, but ultimately must comply with existing Florida law.
